These Terms of Service (“Terms”) govern your use of the LaunchMe macOS application (“LaunchMe,” the “App”) provided by us (“we,” “us”). By downloading, installing, or using the App, you agree to these Terms.

If you do not agree, do not use the App.

1. Two ways to obtain LaunchMe

1.1 Mac App Store version

If you obtain LaunchMe from the Apple Mac App Store, your use may also be subject to Apple’s applicable terms, including the Mac App Store terms and Apple Media Services Terms, and Apple’s standard EULA where applicable. If there is a conflict between these Terms and Apple’s required terms for App Store distribution, Apple’s terms control for the App Store version to the extent required by Apple.

1.2 Website-distributed version

If you install the website-distributed version (downloaded from launchmeapp.com or our official distribution pages, outside the Mac App Store), these Terms apply together with any checkout terms presented by our payment provider (Paddle) at the time of purchase.

2. License grant

Subject to these Terms and your payment status (if applicable), we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on supported macOS devices you own or control.

5.1 Mac App Store purchases

Purchases through Apple are billed and managed by Apple. Pricing, renewals, cancellations, and refunds may be governed by Apple’s policies.

5.2 Website-distributed purchases

Purchases through the website-distributed checkout may be processed by Paddle (or another provider we disclose at checkout). You authorize us and our payment providers to charge applicable fees and taxes as shown at checkout.

Subscription auto-renewal: If you purchase a subscription, it may renew automatically until canceled in accordance with the checkout disclosures and applicable law.

6. Updates

We may provide updates (features, security patches, compatibility). The website-distributed version may update via mechanisms such as Sparkle. Updates may be required for continued use where reasonably necessary for security or compliance.

7. Intellectual property

The App, branding, and related materials are protected by intellectual property laws. Except for the limited license above, we reserve all rights.

8. Third-party services

The App may rely on third-party services (Apple, authentication providers, payment providers, analytics in the website-distributed version). Your use of those services may be subject to their terms.

9. Disclaimer of warranties

To the maximum extent permitted by law, the App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We may modify these Terms by posting an updated version. Material changes may require additional notice where required by law. Continued use after the effective date constitutes acceptance unless applicable law requires otherwise.

13. Governing law; venue

These Terms (and any dispute arising out of or relating to these Terms or the App) are governed by the laws of the State of California, without regard to its conflict-of-law principles.

You agree that the state and federal courts located in Los Angeles County, California will have exclusive jurisdiction over any such dispute, and you consent to personal jurisdiction there, except where prohibited by mandatory consumer protection laws in your country of residence.
